This concerns PSHS-SMC's directive for the Bureau of Immigration to place its graduates under a watch list. It has come to our attention that all 819 graduates of PSHS-SMC are under said watch list and will be denied travel outside unless a clearance is secured from your office.


All these give rise to an unacceptable, illegal situation that should be rectified immediately. Thus, we would like to request prompt action in recalling this directive and withdrawing the watch list to stop the implementation and any further illegality.


We strongly oppose PSHS-SMC's directive for the following reasons:


First, it violates our constitutionally protected right to travel. Under the 1987 Philippine Constitution, only a law passed by Congress may restrict the right to travel in the interest of national security, public safety, or public health. As of this writing, there exists no law prohibiting PSHS-SMC graduates from traveling abroad. Moreover, we are hardly threats to national security, public safety or public health warranting the deprivation of our right to travel. None of us has been convicted or accused of any criminal offense.


Second, the end sought by PSHS-SMC does not justify the imposition of the watch list. According to the school registrar, the watch list is the only way by which PSHS-SMC could track down its graduates and enforce compliance with the contractual obligation of finishing a science degree. It is not. The manner adopted by PSHS-SMC to accomplish this is end, through the imposition of a watch list, is illegal and whimsical. PSHS-SMC has not undertaken steps to contact its alumni and legally demand from them compliance of the contractual obligation.


Third, the PSHS-SMC did not notify its graduates about the directive. We learned about the watch list only from a fellow alumna who was actually prevented from leaving the country last February 11, 2007 on account of the PSHS-SMC directive. Totally unaware of the existence of the watch list, said alumna suffered not only inconvenience but also humiliation in front of her superior and was prevented from performing her professional duties. At first, we disregarded it knowing fully well that the directive impinges upon our constitutional right to travel, thus, a directive of this nature would not pass the legal scrutiny of the Bureau of Immigration.

As it is, PSHS-SMC has not exerted efforts to officially notify its graduates of the existence of a watch list. It is noteworthy that a law requires publication before it becomes effective. This directive, which impinges on our freedom to travel, should have been treated similarly.


Fourth, the watch list does not recognize valid distinctions. All 819 graduates of PSHS-SMC are placed under the watch list, without distinguishing between those liable for breach and those who complied with contractual obligations. The watch list imposes a burden on all 819 alumni to clear their names before they can travel abroad. This burden is unfair and unwarranted. And even if there was a violation of contractual obligation, considering the nature of an immigration watch list, which is often a preventive measure to ensure prosecution of criminal offenses, the blanket imposition of this burden on all 819 alumni is excessive.


Last, nowhere in the contract between PSHS-SMC and the scholar is it expressly or impliedly stipulated that in case of breach, the party liable for breach of contract shall be banned from traveling outside the Philippines. The contract does not authorize the requirement of a travel clearance to ensure compliance with its terms and conditions.  In any case, the validity of this contract remains an open question for the courts to decide.


In view of the urgency of the matter, we request the recall of the watch list for reasons abovementioned. We appreciate receiving your written response the soonest possible time. We have already scheduled our respective trips and will be greatly prejudiced by the implementation of the directive.


We hope for your immediate action on this matter. Otherwise, we are constrained to take the necessary steps to invoke full protection of the law.
